PLENARY SESSION (PM)

A New Phase (and Face) of Law: Opportunities and Challenges in the ASEAN Economic Community (AEC)
This session will sketch the opportunities and challenges in the AEC. An overview of areas involved e.g. transactional, regulatory, dispute resolution, disruptive technology, competition, data protection. The possibility of AEC inter-facing with other economic initiatives e.g. BRI. To discuss how the AEC should evolve perhaps drawing on the lessons of other economic communities.

SESSION 2 (PM): PARALLEL SESSION 1

Fair, Effective and Efficient Dispute Resolution to Facilitate the Success of the AEC
This parallel session will discuss possible dispute resolution mechanisms including ADR for cross-border transactions/multi-jurisdictional disputes. Issues discussed could include service of process and enforcement of judgments/arbitral awards/settlements.

Moot – Judicial review of administrative action contravening certain ASEAN agreements

Law as an Instrument to Facilitate the Success of the AEC

This plenary session will discuss in what areas legal convergence could facilitate the success of the AEC. A specific area of convergence that will be discussed will be cross-border insolvency.

Disruptive Technologies on Business Landscapes in ASEAN: Opportunities and Challenges

New and disruptive technologies are transforming business models both in domestic and international markets. How can the law and regulators facilitate and meet challenges of
disruptive/new technologies to facilitate trade in the AEC ? Paper will focus on Fintech and IBM will conduct a short demonstration for understanding of the underlying blockchain technology.

 

PLENARY SESSION (PM)

Power of ONE: AEC Financial Integration

This session will focus on AEC Financial Integration as harnessing the Power of One. Aspects of financial integration could include cross-border listings, bond/fund-raising programme in AEC, the ASEAN Collective Investment Schemes Framework and common disclosure standards.

 

PARALLEL SESSON 1 (PM)

Competition Law in the AEC
This session will discuss the various approaches to competition law in the AEC and how the ASEAN regimes can be harmonised to facilitate the AEC.

PARALLEL SESSION 2 (PM)

Rule of Law-Role in Attracting Trade and Investments in ASEAN – Free Trade Agreements and Bilateral Investment Agreements in ASEAN countries
This session will discuss how investors and businesses can leverage on FTA and BIT agreements amongst ASEAN member States as well as between ASEAN member states and other FTA partners e.g. China-ASEAN investment agreement to protect their investments. It could cover recent developments in investor-State disputes and lessons for ASEAN.

Cross-Border Obstacles in ASEAN and Solutions
This session will seek to identify cross-border obstacles to trade and investments in ASEAN and the possible solutions from the perspectives of policy-makers, legislators, in-house counsel and practising lawyers.

Stock-taking and the Way Ahead
This final session is intended as an ‘armchair’ discussion to stock-take the recommendations and outcomes over the past 2 days and discuss the way ahead and possible concrete steps that can be recommended or further explored.

Participants who attend Day 3 (28 July 2018) and comply strictly with the Attendance Policy on that day may obtain 3 Public CPD Points. Participants who do not comply with the Attendance Policy on any particular day of the event will not be able to obtain CPD Points for that day.
